How Does Divorce Mediation Work in Orange County?
Divorcing spouses meet with a mediator – who acts as an impartial third party – to negotiate terms for the dissolution of their marriage. How many times parties meet with a mediator depends on the circumstances of the case. In a complex divorce where the couple shares valuable assets, have commingled property, and has children together, multiple meetings may be necessary. In a divorce where the couple already has a marital agreement dictating how they intend to divide property, and they don’t have children, mediation can resolve in as little as a single meeting.
During mediation, parties collaborate to decide how they want to handle the following issues:
- Alimony/spousal support
- Property division
- Child support
- Child custody
After spouses have successfully negotiated equitable terms, their A.D.S. Certified Mediator will draft an agreement detailing those terms. Once the agreement is approved by both spouses, the agreements will be filed with the court for a judge’s approval to finalize the divorce.
