Types of Marital Property

In California, there are two types of marital assets: separate property and community property. Separate property covers all of the assets that were acquired by either spouse before marriage, and thus solely belong to one spouse. It also includes gifts or inheritances that are explicitly given to one spouse during the marriage. Separate property is not divided between the spouses during a divorce.
